1. Agreement to Terms
By accessing or using the services provided by Delta Studio ("Company," "we," "us," or "our"), you ("Client," "you," or "your") agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services.
2. Services Provided
Delta Studio provides website design, development, and related digital services including but not limited to:
- Custom website design and development
- E-commerce solutions
- Website maintenance and hosting
- SEO setup and optimization
- Terms & Conditions and Privacy Policy drafting
3. Hosting and Uptime
3.1 Hosting Services
Delta Studio may provide hosting services as part of certain packages or as an add-on service. Monthly maintenance and hosting is billed at $30/month unless otherwise specified in your package agreement.
3.2 Traffic Limitations
Monthly maintenance and hosting includes support for up to 10,000 monthly visitors per website. Sites exceeding this traffic limit may incur additional hosting fees at Delta Studio's discretion to cover increased infrastructure costs.
3.3 Limitation of Liability for Downtime
IMPORTANT: Delta Studio is not liable or responsible for any website downtime, service interruptions, data loss, or unavailability, even when Delta Studio is providing hosting services. Websites are provided on an "as-is" and "as-available" basis. We make no guarantees regarding uptime, availability, or uninterrupted service.
By using our hosting services, you acknowledge and agree that:
- Website downtime may occur due to server maintenance, hardware failure, network issues, third-party service outages, or other unforeseen circumstances.
- Delta Studio will make reasonable efforts to restore service but makes no guarantees regarding response time or resolution.
- You are responsible for maintaining your own backups of critical data and content.
- Delta Studio shall not be liable for any lost revenue, lost business opportunities, or other damages resulting from website downtime or unavailability.
3.4 Maintenance Services
Monthly maintenance includes routine updates, security patches, and minor fixes. However, Delta Studio reserves the right to charge additional fees for:
- Major bug fixes or issues requiring substantial troubleshooting
- Feature additions or modifications beyond the original scope
- Emergency support or urgent fixes outside of business hours
- Issues caused by client modifications, third-party plugins, or external services
- Any maintenance work requiring more than 2 hours of development time
Additional maintenance fees will be communicated and agreed upon before work begins.
4. Pricing and Payment
4.1 Package Pricing
Our current package pricing is as follows:
- Basic Package: $249 (1-2 pages, no SEO, monthly maintenance)
- Starter Package: $699
- Professional Package: $1,899
- Premium Package: $3,899+
4.2 Negotiable Pricing
All prices listed are negotiable. Clients may request to discuss pricing during the intake process or afterwards.
4.3 Payment Terms
A 50% deposit is required to begin work. The remaining balance is due upon delivery or launch of the website. Delta Studio reserves the right to suspend or terminate services for non-payment.
5. Referral Program
Delta Studio operates a referral program that rewards users who successfully refer paying clients. Important terms:
- Referral rewards are only paid when the referred party actually purchases a website — not upon registration or sign-up.
- Reward amounts: $200 for Starter ($699+), $400 for Professional ($1,899+), $800 for Premium ($3,899+). No referral rewards for Basic ($249) package.
- Referrals are tracked via unique referral codes generated at account creation.
- Delta Studio reserves the right to terminate referral accounts found to be abusing the system.
6. User Accounts
To participate in the referral program, you must create an account. When creating an account:
- You must provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your password.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized access.
7. Project Delivery
Our standard delivery timeline is 5 business days for Basic, Starter, and Professional packages. Premium packages have custom timelines agreed upon during project planning. This timeline begins once we have received:
- All required content (text, images, logos)
- The 50% deposit payment
- Any necessary access credentials
Delays in providing these materials will extend the delivery timeline accordingly.
8. Revisions
Each package includes up to 20 rounds of revisions. Additional revisions beyond this limit may be subject to additional fees at our discretion.
9. Intellectual Property
8.1 Client Ownership
Upon full payment, the client receives full ownership of the final website files and design.
8.2 Company Portfolio Rights
Delta Studio retains the right to display completed projects in its portfolio and marketing materials unless otherwise agreed in writing.
10. Content Responsibility
Clients are responsible for providing all content including text, images, and media they wish to appear on their website. Clients warrant that they have the legal right to use all provided content.
11. Refund Policy
Due to the custom nature of our work, all deposits are non-refundable once work has commenced. Clients who wish to cancel before work begins may receive a full refund of their deposit.
12. Warranty and Limitation of Liability
Delta Studio provides a 30-day warranty on all work performed. During this period, we will fix any bugs or issues at no additional cost.
IN NO EVENT SHALL DELTA STUDIO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE.
13. Termination
Either party may terminate the service agreement with written notice. Upon termination, the client is responsible for payment for all work completed up to the termination date.
14. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
15. General Provisions
14.1 Entire Agreement
These Terms constitute the entire agreement between you and Delta Studio regarding the use of our services.
14.2 Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms.
14.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
14.4 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
